Welcome to Genius Authors LLC (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our services, including our website, translation and marketing services, and any other related offerings. By using our services, you agree to these Terms. If you do not agree, please do not use our services.

  1. Services Provided

We work with authors to:

  • Translate their books into multiple languages, including Spanish, German, Japanese, French, Italian, Turkish, Polish, Dutch, Arabic, and more.
  • Produce AI-generated audiobooks.
  • Market and advertise these versions on platforms like Amazon, Apple Books, and social media.

We use advanced machine translation tools, including DeepL, to generate the first draft of translations. These drafts are then professionally edited by native translators to ensure quality, tone, and accuracy.
We offer these services on a royalty-share basis for a limited period, as outlined in your agreement.

Please note: We selectively choose the projects we take on. We are not obligated to respond to every request or accept every submission.

  1. Author Rights and Responsibilities

By engaging with us, you confirm that:

  • You are the copyright holder of the book or have legal rights to authorize its translation and audiobook creation.
  • You have not assigned language or audiobook rights to another party.
  • You retain all intellectual property rights to your original work.
  • You agree to indemnify us against any claims, disputes, or legal issues concerning ownership rights.

  1. Royalty Terms

For 12 weeks from the translated edition’s publication date, Genius Authors LLC receives 100% of the royalties. After this period, all royalties revert to the author unless an extension is agreed upon.

The author may opt to continue services, during which Genius Authors LLC retains 100% of royalties for the extension period. After that, royalties return to the author in full.

  1. Termination and Cancellation Fees

Either party may terminate this agreement with 30 days’ written notice. If the author terminates before the end of the initial or extension period, a cancellation fee of $12,000 will apply.

  1. Case Studies, Marketing Materials, and Social Media

By working with Genius Authors LLC, you grant us permission to:

  • Create case studies and promotional content that highlight the work we’ve done together.
  • Share quotes, images, and non-confidential outcomes from our collaboration.
  • Publish posts on our social media channels referencing your project.

We will never disclose sensitive or confidential information without your written consent.
If you prefer not to be featured, simply notify us in writing, and we will exclude your project from any public materials.

  1. Confidentiality

We keep all non-public information (e.g., marketing plans, royalty reports) confidential for at least five years after the agreement ends.

  1. Limitation of Liability

Genius Authors LLC is not liable for any indirect, incidental, or consequential damages resulting from your use of our services.

  1. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of Delaware, USA.

  1. Dispute Resolution

Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, the matter will be submitted to binding arbitration in Delaware under AAA rules.

  1. Modifications

These Terms may be updated from time to time. Continued use of our services after changes means you accept the new Terms.

  1. Eligibility

To use our services, you must be at least 18 years old and legally able to enter into contracts. By working with us, you confirm you meet these requirements. We reserve the right to accept or decline any submission at our discretion.

  1. Payment Handling

While we work on a royalty-share basis, any platform fees, taxes, or transaction fees from third-party platforms (e.g., Amazon, Audible) will be deducted before royalties are calculated. These deductions are outside our control and are the author’s responsibility.

  1. Platform Access

The author agrees to provide necessary access to their publishing platforms (e.g., Amazon KDP, Amazon Ads) as required to publish and manage the translated edition and/or audiobook. Failure to grant timely access may delay or terminate services.

  1. AI Voice Consent

By engaging us for AI audiobook creation, you acknowledge and consent to the use of synthetic voice or voice cloning technology, which may not involve a human narrator.

  1. No Guarantees

While we use proven marketing strategies, Genius Authors LLC does not guarantee specific sales numbers, bestseller status, or profits.

  1. Force Majeure

We are not liable for any delays or failure to perform due to circumstances beyond our control, including natural disasters, internet outages, or platform disruptions.
